Fulfilment of MixtureCoud’s Service
Last modification : march, 28 2012It’s not compulsory to create an account if you want to use our Services.
However, creating an account allow an optimal use of our Service.
A. Choice of the kind of account
1. Creating a free or paying account
If you want to create an account, you just need to fill in your email address, choose a password and accept our Terms of use. You also have to choose the kind of account you wish : paying or free. You will receive a confirmation email that attest the creation of your account. In order to secure your account, you can validate your email address by clicking on the link you received in this email. This procedure is not compulsory, but it’s strongly advised.
MixtureCloud keeps its right to terminate free accounts at any moment, with notice or not.
Without limiting what precede, MixtureCloud can delete all or part of your files, without any notice, if your free account remain inactive during 100 days.

2. Transfer from a free to a paying account
You can increase your storage limit, over than 30 GB by buying an account. In that case, you will be presented to the specific conditions of the account you had chosen, and you will no longer be compelled to the restrictions imposed on free accounts.
The payment methods are detailed in the following part payment.
By choosing a paying account MixtureCloud, and by giving to Paymentwall your datas allowing them to process to the payment, you admit that you accept the payments’ methods detailed in these conditions.
Your paying account MixtureCloud will remain active, unless you decide to stop it or if we terminate it.
3. Transfer from a paying to a free account
You can choose to transfer your paying account to a free account. To do so, you will have to go on your MixtureCloud’s profile and to cancel your next payment in the tab invoicing. It will be taken into account the month after, at the date corresponding to the renewing of your monthly account.
CAUTION : if your payment method was automatic, you will also have to cancel the automatic payments directly via the payment organization. The action of downgrading your account doesn’t cancel the automatic payment. It’s 2 steps to do distinctly.
If the user doesn’t cancel his automatic payment on time, the money corresponding to the month paid will not be given back, even if the user had previously downgraded his account on his profile. In that case, MixtureCloud will extend the paying account, accordingly to the payment made.
B. Payment methods
MixtureCloud is using the services of Paymentwall, which accept every existing method of online payment. For more information, you can visit their website thanks to the following link: www.paymentwall.com
The user is responsible for the payment method he chooses. By doing your payment, you will activate an automatic payment (if the payment method allows it), without any commitment in the time. Consequently, you can cancel it at any time.
By initializing the automatic payment, you accept that the payment organization will pay us every month the amount due. Your automatic payment will be renew via Paymentwall monthly, at every anniversary of the opening of your paying account. If your paying account had been opened a day that doesn’t fit with some months, your payment will be done the last day of the month concerned (for instance if your paying account had been opened a 31st january, the next payment will be done on the 28th February).
Automatic payments are only initialized for lasting 12 months maximum. That means that if you buy a paying account by initializing an automatic payment, you will pay every month the amount chosen for your paying account in the limit of 12 months (unless you cancel it before). If after that you wish to pursue your paying account, you will have to initialize again an automatic payment.
Automatic payment is not allowed by all payment methods. If the automatic payment is not available with the payment method that you use, you will have to renew the operation every month so that your paying account remains active.
If you wish to cancel the automatic payment, you will have to do this through the payment method you used.
CAUTION: cancelling the automatic payment will not lead to the cancellation of your paying account. If you cancel your automatic payment, but keep a paying account in your account settings, you will still be invoiced for the amount corresponding to the account you subscribed for.

If Paymentwall is not able to proceed to your payment thanks to the information you provided, then MixtureCloud can restrict the access to the use of your account and of your files. If you don’t settle the situation within 5 days following the notice from MixtureCloud, MixtureCloud can delete all or part of your files. If so, your account will instantly be transferred as a free account and your storage capacity will be limited to 30 GB.
You can check the payment status of your account straight on the payment page of MixtureCloud, thanks to the link at the bottom on the right hand side «missing».
If a payment has been done, but not credited to you, you can directly send an email to Paymentwall to fix it.
C. Rates
You can at any time check online the rates in effect for the paying accounts, at the following address : http://www.mixturecloud.com/price
The rights and fees are non refundable. Period of subscription partially passed will not be refund or credited again.
MixtureCloud can amend the current rates. Nevertheless, the cost of your current paying account will not be amended. That means that if MixtureCloud increased the price of the 1month paying account, the price will remain the same for a user that had subscribed to it before the price had increased.If the price of the monthly account decrease, the user will receive additional days corresponding to the pro rata basis of the price paid. The price will be updated once the 1 year deadline, from the buying date, will be passed or if the user terminated his account in between.
D. Invoicing
The payment of your paying account is invoiced from :
The day you bought your paying account
The day you converted your free account into a paying account
You can check your profile page in order to know the status of your account.
You have to make sure that your datas (personal and concerning your payment method) are updated.
E. Refund
MixtureCloud’s paying accounts are payed in advance, and no refund will be done.
MIXTURECLOUD DOESN’T MAKE ANY REFUND, FOR THE MONTHS OR YEAR PARTIALLY PASSED.
F. Closing your account
If you wish to close your account, you need in a first time to cancel the automatic payment of your paying account with Paymentwall, so that we don’t receive anymore monthly payment from them.
Then, you only have to click on «closing my account».
CAUTION : deleting your account is considered as permanent.
If you wish to restore your account, because of a mistake of manipulation from you, you need to write us at MixtureCloud’s support at the following address: support@mixturecloud.com , by specifying in the subject «restore my account»
You can close your paying account at any time ; this deletion will take effect immediately, even if the current month had already been charged to you.
If you choose to close your paying account, please be aware that we will not refund you your most recently paid monthly account (neither any other).
If the user doesn’t delete the automatic payment, while he closed his account, the account will automatically be restored so that the user can enjoy the month he has been charged for.
Once the closing of the account done by the user, MixtureCloud keeps its right to delete previously hosted files. Consequently, those files will be inaccessible to the user for good.
G. Suspension of the Service
If the use of one user constitute a danger for the constancy and the safety of MixtureCloud, we can suspend the service of that user.
If necessary, we also keep the right to interrupt our Services for a technical operation or any other maintenance operation.
OPERATION CONDITIONS
By accepting these conditions, you admit that some elements can lead to an instability of the services provided by MixtureCloud (for instance, variation of the bandwidth,hazards of the access provider). Those are elements outside from MixtureCloud’s technical resources.
